§ 1 General provisions

1. This agreement (Terms of Service) describe the terms of use of the Service, delivering free service in electronic way, copyright restrictions.

2. The Service Manager and Owner is Director of Customs Chamber in Bialystok, 15-339 Bialystok, Octowa str. 2, NIP 5450002929, REGON 000143751.

3. The Service Owner reserves the right to change the Terms of Service without prior notification to the User.

4. Every time when using the Service, the User confirms that is acquainted with the Terms of Service and accepts its provisions.

5. The legal basis of the terms of service:

·    Customs Service Act of 27 August 2009 (Journal of Laws No. 168, item. 1323, as amended);

·    The Act on tax on goods and services dated 11 March 2004 (Journal of Laws No. 54, item. 535) the consolidated text of 29 July 2011 (Journal of Laws No. 177, item. 1054, as amended);

·    The Act on copyright and related rights of February 4, 1994 (Journal of Laws No. 24, item. 83) the consolidated text of 17 May 2006 (Journal of Laws No. 90, item. 631, as amended);

·    The Act on Personal Data Protection of 29 August 1997 (Journal of Laws No. 133, item 883). the consolidated text of 17 June 2002 (Journal of Laws No. 101, item. 926, as amended).

§ 2 Definitions

The following terms used in the agreement mean:

1. User:

traveler, natural person not having permanent place of residence in the territory of the European Union, who uses the Service located at https://granica.gov.pl/TaxFree

2. Administrator - the Service Owner – Director of Customs Chamber in Bialystok.

3. Service – Internet service located at https://granica.gov.pl/TaxFree

4. Cookie files – a small pieces of data sent from a website and stored in a user's web browser. Cookie parameters allow to read included data only for the server that created it.

§ 3 Technical conditions of using the Service

1. It is necessary that the user's web browser accepts cookies. files to use the Service. The Service uses cookie files to store information on the User’s computer. Cookie files are created at the moment when the connection is encrypted by secure SSL protocol and are necessary to protect the data transmitted by the User to the Service.

2. Administrator informs users, by the Service or email, about possible interruptions in functioning the Service or its parts in planned (daily service and maintenance of server or software) or unplanned (failure having impact on functioning of the Service, independent on the Administrator) cases.

§ 4 Data acquired by the Service

1. The following data from the User’s web browser is acquired automatically by the Service:

a)  date and hour of data transfer,

b)  IP number of the computer used to fill in the form,

c)  kind of web browser used by the User;

2. Using the form, the User inserts the following data concerning:

a) issuer (Seller):

i)  NIP,

ii) REGON,

iii)   name,

iv)   place,

v) street,

vi)   building No,

vii) room No,

viii)  postal code,

ix)   post,

x) voivodeship,

xi)   county,

xii) district;

b) traveller:

i)  name,

ii) surname,

iii)   country,

iv)   passport No;

c) account:

i)  account No,

ii) date of issue,

iii)   value,

iv)   predicted custom branch of export;

d) range of goods:

i)  general information on exported goods;

§ 5 User’s rights

1. User – it is not obligatory to the Traveller to register in the Service.

2. It is the right of the User to declare exported goods by filling in the form with data from the document mentioned in art. 128 par. 2 of the Act of 11 March, 2004 on Tax on Goods and Services (Journal of Laws no. 54 item 535 as amended).

3. Total gross value of goods in a single document inserted by the User, must not be less than 200 PLN.

4. It is the right of the User to get information mentioned in art. 32 par. 5 of the Act of 29 August, 1997 on Protection of Personal Data (Journal of Laws no. 133 item 883 as amended), not more than once every 6 months.

§ 6 Administrator’s rights

1. Administrator – Director of Customs Chamber in Bialystok, Customs Service organ, according to art. 2, 7, 8 i 30 of the Act of 27 August, 2009 – on Customs Service (Journal of Laws no. 168 item 1323 as amended) and art. 106, 128 of the Act of 11 March, 2004 on Tax on Goods and Services -VAT (O.J. no. 54 item 535 as amended) is authorized to process personal data – even without permission of the persons concerned.

2. When performing control at border check points, connected with confirmation of export of goods declared in document mentioned in art. 128 par. 2 of the Act of 11 March, 2004 on Tax on Goods and Services - VAT (Journal of Laws no. 54 item 535 as amended), Administrator is authorized to verify data given in the Service by the User.

3. According to art. 8 par. 1 of the Act of 27 August, 2009 – on Customs Service (Journal of Laws no. 168 item 1323 as amended), information obtained from the User of the Service, which is subject to protection in accordance with other legislation, shall be customs secret and may not be circulated by the Administrator without consent of the User which made it available. Information classified as customs secret, including personal data, may be transferred when the custom authority is obliged thereto or authorized in accordance with effective acts.

§ 7 Requests for enquiries

1. Any request for enquiry or proposal for amendments shall be sent to Director of Customs Chamber in Bialystok to the postal address as in § 1 par. 2 or to email address ic.bialystok@bia.mofnet.gov.pl

2. Request for enquiry shall be considered within 30 days from its effective delivery. Response to enquiry shall be sent to email address show in request for enquiry or to another email address indicated by the User.

§ 8 Copyrights

1. Author’s economic rights to the content of the Service are owned by the System Administrator and by authors of individual publications and materials. Author’s rights enjoy copyright protection established in act of February 4, 1994 on Copyright and Related Rights (Journal of Laws no. 24 item 83 as amended). By making use of the Service the User does not acquire any rights to non-material goods to the works contained in the Service. The User is authorized to use these works within the scope defined in Copyright Act, after granting permission in writing form from the Administrator. Equivalent of writing form is permission delivered by email.

§ 9 Final provisions

The Terms of Service come into force on 9 July 2013 and are published on the website www.granica.gov.pl/TaxFree
